Nobody goes into marriage with hopes of divorce.  The fact is that 60% of marriages end in divorce.  Of those more of them could have been dissolved peacefully, but instead ended in a fight over what each will keep and what each will pay.  

When two people get married, their obligations and liabilities can go beyond love’s sake and could apply to financial liabilities and entanglements.  These financial problems can lead to unnecessary fighting and potentially astronomical court costs because you were afraid to discuss with your partner the “what if” scenario of divorce beforehand.

Divorce

QDRO

Does your divorce settlement entitle you to a portion of your ex-spouse’s retirement benefits? If so, you will need to file a Qualifying Domestic Relations Order (QDRO). A QDRO is an Order directing a Plan Administrator to split retirement or annuity benefits based on a Marital Settlement Agreement.  It is required by the courts before the Plan Administrator can establish the funds in your name.

Drafting and Filing a QDRO can be quite complicated if you are not familiar with the process.  In addition, each Plan Administrator has specific requirements to approve a QDRO before the funds can be divided between the parties.
