Prenuptials & Postnuptials
Nobody goes into marriage with hopes of divorce. The fact is that 60% of marriages end in divorce. Of those more of them could have been dissolved peacefully, but instead ended in a fight over what each will keep and what each will pay.
When two people get married, their obligations and liabilities can go beyond love’s sake and could apply to financial liabilities and entanglements. These financial problems can lead to unnecessary fighting and potentially astronomical court costs because you were afraid to discuss with your partner the “what if” scenario of divorce beforehand.
Know what will happen and take away the uncertainty of what is going to happen if we go down the path of divorce. Start the financial conversation with your future spouse before you get married to make for a smoother marriage.
Don’t be afraid to have that uncomfortable conversation of how you will handle your finances even in the tragic “what if” scenario.
Divorce
It is not an easy decision for a couple to file for a divorce. However sometimes it is necessary. Luckily not all divorces end in war. When both parties are in agreement on how to divide their assets and liabilities they tend to end peacefully.
However, filing for a divorce is a difficult process, which can lead to unnecessary fighting, especially when there are children involved. Which only adds stress on the children, in an already stressful time for them.
In addition to that, if you don’t know your rights or know how your assets should be protected you could be leaving more on the table than you should be.

QDRO
Does your divorce settlement entitle you to a portion of your ex-spouse’s retirement benefits? If so, you will need to file a Qualifying Domestic Relations Order (QDRO). A QDRO is an Order directing a Plan Administrator to split retirement or annuity benefits based on a Marital Settlement Agreement. It is required by the courts before the Plan Administrator can establish the funds in your name.
Drafting and Filing a QDRO can be quite complicated if you are not familiar with the process. In addition, each Plan Administrator has specific requirements to approve a QDRO before the funds can be divided between the parties.
We offer our services in drafting and filing your Qualified Domestic Relations Orders. Let us take care of the heavy lifting for you, while you focus on establishing your new life.
